Terms and Conditions
Websmart Websites
These terms and conditions are specifically for the Websmart Site product. Terms and conditions for other Websmart Inc. products are provided separately as part of a development contract.
Payments
- Website Site Package
Is due via credit card online payment (or other arrangement) upon product selection, before work begins.
- Subscription
Monthly or annual, is paid by credit card and is due when the website goes live. Renewals are automatically charged to the credit card on file on the first day of the month. Incomplete renewals will result in site being suspended and possibly deleted. An administration fee of $75 dollars is due to reactivate the site within a reasonable amount of time. - Additional Services
Any additional work not covered in the package selected must be authorized in writing (email). Client agrees to pay the standard rate of $75 per hour for such services, or if under a Webmaster Support Agreement $55/hour.
- Taxes
Websmart Inc is an Ontario incorporated company. As such we are required to charge 13% HST on our services.
Copyrights and Trademarks
- The client represents to Websmart Inc. and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks or other artwork furnished for inclusion in web pages are owned by the client or that the client has permission from the rightful owner to use each of these elements. The client must have appropriate copyright clearances and permissions. The client will hold harmless, protect and defend Websmart Inc. and its subcontractors from any claim or suit arising from the use of such elements provided by the client. To the best of Websmart Inc.’s knowledge and belief, our work does not violate any copyrights.
- Copyright for creative works such as photos, graphics, and creative elements used in the website remain the property of their respective creators, unless otherwise specified or purchased for the project with appropriate license.
Laws Affecting Electronic Commerce (where applicable)
From time to time governments enact laws and levy taxes and tariffs affecting Internet electronic commerce. The client agrees that the client is solely responsible for complying with such laws, taxes and tariffs, and will hold harmless, protect, and defend Websmart Inc. and its subcontractors from any claim, suit, penalty, tax, or tariff arising from the client’s exercise of Internet electronic commerce.
Our Product
- Websmart Sites are a proprietary product and cannot be transferred or moved to another server or service. Content belongs to the client, unless otherwise specified. Stock images or other design content purchased on behalf of the client belong to the client. Copyright of the design itself remains with Websmart Inc.
- Websmart Inc does not guarantee we can take on every project that is presented. We reserve the right to limit services..
- We reserve the right to reject projects or clients that we deem harmful to our service or other websites that we manage within our environment.
